AG accuses two MPs of treason, seeks their prosecution
Attorney General Dr. Ahmed Dahir has sought orders from the Lower House to strip two lawmakers of their immunity for prosecution following investigations the two had committed treasonable offenses.
Dr. Dahir said two MPs from Galmudug-Hassan Mohamed and Abdisabir Shuriye were involved in activities which constitute treason. The two, the AG said had received funds from outside the country to commit treasonable offenses and mobilise illegal activities in the country.
“After lengthy investigation, the MPs Hassan Maalin Mohamed and Abdisabir Noor Shuriye were found to have committed a criminal act which needs to be prosecuted before a court of law,” Dr. Dahir said.
“We want to make clear the existence of leaders, MPs who were recently engaged in activities to bring down the government while using funds from foreign countries and the law must take effect against them,” said Dahir
“I have today submitted findings of the investigation which contains evidence against the two MPs to the Speaker of the Lower House and I also sought leave of the House to strip them of their immunity. They MPs Hassan Maalin Mohamed and Abdinasir Noor Shuriye,” said Dahir.
Dahir added the two were involved ‘in activities aimed at destroying the Somali nation’.
The Provisional Constitutional gives lawmakers immunity from prosecution but leaves the definition of immunity to legislation.
Article 70 (2) reads thus: Without the approval of the House of the People of the Federal Parliament, no member of the House of the People of the Federal Parliament may be prosecuted for a criminal offense, be detained, or be physically searched, and nor may the member·s house or other dwellings be searched unless the member has been caught in the act of committing a crime that calls for compulsory detention orders. Furthermore, without the approval of the House of the People of the Federal Parliament, no member may be detained or imprisoned, even in the fulfillment of a final court.”
A special law shall define the immunity of the members of the House of the People of the Federal Parliament, article 70 (4) adds.
